WINTER RATES & GUESTS:
 
All Winter Guests must have adequate Propane Heat source in their RV.
We allow $100.00 of electricity usage per site in the RV site Rate anything over that will be billed to you st .15 cents per kwh.
We ask that you provide your own Heated Hose to prevent Freezing pipes. Heated Hoses run approx. $2.00 per day in electricity usage and this is your additional cost to stay during the winter months.
  So please be aware of this. If you elect to Option out of a Heated Hose: Caution: Your RV pipes may freeze and a regular hose will definitely freeze. We are not responsible for this should it occur or that it puts you without water due to a frozen hose or anything that freezes up on your RV. Propane Heat is required for main source of Heat. If Electric Heaters are ran as a supplement or as primary heat source then you will be responsible for anything or cost over the allocated $100.00 allowance. Winter rates and other rates are subject to change without further notice or via verbal, or text notice of those changes if rates should increase. We have our water risers in heated boxes which helps to keep most of the time the lines from freezing, however, it has occurred and when it does all we can do is wait for them to defrost.

INTRODUCTION:
Howdy there, Please: YOU MUST E-SIGN the policies sent to you in your confirmation email in that we can confirm and accept your reservation please. Click on the link provided in the confirmation e-mail you will receive please! However, If you are unable to get this e-sign back to us than you are still in complete agreeance with all Park rules and agree that by making , confirming and paying for your reservation that you have read and agree to the policies. We are a beautiful, peaceful place. Welcoming positive people, Happy Travelers, fun and great energy and aim to provide a relaxed, laid back experience and atmosphere. Hope to make you feel right at home. In fact while you are here you are Home!

We do prefer to be as ECO - Friendly as possible and ask that our guests assist in in keeping the "Rocky Mountain Area" and "Black Bear" Beautiful, Clean and Pleasant.

Our aim is to cater and service a clientele that is in agreeance with our rules and policies , all learned from the lessons and experiences and of the Rocky Mountain elements and all that come with it. Thank you for understanding why the need for them exists: in that you experiences the best possible Vacation Stay with us.

We do have some rules and policies in place...
mostly learned and incorporated from trials and errors and 1st hand experiences, however, our policies are that we can cut out the "riff raft" and serve a like minded clientele that understands the need for policy and awareness while vacationing in the Rocky Mountains.
By all means Please read and familiarize yourself with our park rules and policies. You may elect to opt out and not reserve with us if you are not in agreeance with our policies. Any suggestions are certainly appreciated. Thank you kindly!

NOTE: We NO LONGER Accept extended stays; You can reserve for 14 days at a time only. You will have to renew your guest agreement every 14 days if you intend to stay longer. based upon approval of the office/owner and your prior stay we will authorize it if there have not been any major issues. This is up to the owners discretion.

1. We are a DRUG FREE Establishment ( Cannabis Friendly Only) Just for you, our Guests.
We do not tolerate Drugs, Violence, Domestic Violence, Disturbances, Guns, Drunken Disturbances or Loud Obnoxious Behavior of any sort. As we aim to an prefer to keep things calm, fun, relaxing and beautiful. Please understand that we will treat you with kindness and respect, however, we will not tolerate Disrespect to Black Bear Staff or Owners or to any of the guest that stay with us. Thanks so much for your cooperation.
Treat others as you would like to be treated please!
If something should get out of hand, We do have the immediate right to ask the disturbing guest/s that violate our rules, property or acts out in disrespect to us or guests in any form or fashion will have to leave immediately without notice or refund of the reservation. We would not be happy to have to do so, however, in that we can create a pleasant place for all guests.. Lets please be kind and mindful of everyone.
Our intentions are that we can offer a peaceful, more laid back camping experience that allows you to Nestle in and feel safe and right at home.

Alcoholic Beverages:
Any disturbance , violent behavior, aggression or scenes created due to being under the influence of such Alcohol beverages is immediate grounds for dismissal from the property and we have the right to call the proper law enforcement.

NO GLASS BOTTLES OR CONTAINERS (Please) not allowed on premises please. Glass breaks and can cause injuries to the feet!

NO VEHICLE OR RV WASHING PLEASE: We are on a WELL as most of us are in this valley. Car washes are available in Salida for your use.

*** We ask that you please gain written permission from the office to video tape or record while on the premises and please to respect the other guests kindly do not video other guests without their permission please as they may want to keep their privacy please and Thank You.

2. Black Bear Is NOT Intended as a A Permanent Residence:
Please understand that This Park and Motel or premises is not intended as a Permanent place of residence, but more so as as a Vacation Spot and Place.
We Reserve the right to refuse service to anyone at any given time that is not in compliance with the polices.
We deem the right at any given time to terminate your stay with us based upon any disrupting behaviors or constant rebellion of the Park Rules please and Thank You. Park/Motel policies are listed here in. Thank you so much for understanding that all rules are intended to ensure a great place and RV Park to Vacation at. Thank You.

* NO AFTER DARK ARRIVALS IN THE RV PARK! or Motel. Unless arrangements have been made and an automatic late arrival fee of $35.00 is applied. Our Park is lit with a low light ambiance thus after dark arrivals need special assistance.

DELIVERIES::
You can have Amazon, Fed-Ex or UPS deliveries as we have a UPS/Package Delivery station for that! Its across from the Office.

BOXES:
All card board boxes must be broken down and placed into our card board recycle bin please! We don't have extra room in the dumpster to accommodate these extras. Here in these mountains it is a luxury to have trash disposal service and if we can at any time we aim to recycle as well as help keep our local landfill as clean as possible. Thank you so much!

3. EXTENDED STAYS: ***
We do offer extended stays and accept applications for this type of reservation. Upon approval of the application ( effective August 1st 2020 an application and request to renew form is mandatory) We will contact you and work out the details after your form has been submitted for review.
3 month stays or more can be arranged. (First Months, a deposit and Last months site rent is required.)
We offer Daily, Weekly, Bi-weekly and longer stays ( We do not offer monthly stays) You may stay for 14 consecutive days and then ask for a renewal to extend for another 14 days.

See guidelines and rules on the extended stay renewals at the bottom of this page please. All extensions of reservations must be requested please. As our Reservations are on-line and are visible to travelers to make and reserve RV sites and Motel Rooms that are not booked out in advance.

4. All Guests :
QUIET HOURS: 10PM to 9am
NO loud muffler vehicles in and out of the Park or in and out after 10pm. This is a disturbance to other guests and is a park violation.
a.) Use of the Out Door Common area Party Deck:
This is a shared area and all guests are Welcome to use it.
Special permission and notice/request is needed for Guests that intend to have a gathering, party or group event please get with the office. Thank you.
*Designated Cannabis Smoking area in that we show respect to all guests.

5. PETS WELCOME:
NO AGGRESSIVE BREEDS ALLOWED
Pets must be registered with the office and proof of shot record.
* Pet Deposit and cleaning fees for Motel Room Pets: RV Rentals or RV Sites
* Must be on a leash at all times while roaming the property.
No viscous or aggressive behavior Dogs please. No loud continuous barking dogs please. If others begin to complain over your dog barking all the time then we will have to ask you to keep the dog from barking all the time or no longer have the dog on premises. If your dog seems aggressive to people or other dogs in any way we will ask that you remove the dog off the premises immediately please.
Weight Limit 40-60 lbs. max
Limit 2 Pets per Guests with written permission.
Current Shot Record proof please.
** Scoop the Poop please. It is Pet Owners responsibility to pick up after their pets please. A great way to re-use plastic shopping bags would be for scoop the poop purposes. Thank you!

6 .We have 3 entrances each with entrance gates. 24 hour security cameras up in our park! just to ensure for more safety and protection of our park, all guests and your belongings. We are not responsible for any damage, theft, loss or vandalism to Guests vehicles, RV's etc. We are not responsible for lost, stolen or missing items that you leave behind. We have never had issues with this before but just want you to be aware.

7. PROHIBITED ITEMS:

Drugs of any sort
* NO FIREARMS
BB Guns
Fireworks
Ground Fireworks
Firearms are not allowed on the premises with out written permission, or proper registration and a carry license please.
No Children with BB Gun shooting please.

8. Fires:
NO OPEN BIG BLAZING FIRES Please!
We are in High Desert and must respect our surroundings please. Before you do an open flame fire please contact the Fire Department.
719 -942-4833 Please Call the Howard Volunteer Fire Dept. on days of iffy (windy, very dry or if we are in a fire Ban) get approval first. Lets play it safe in this high desert area.

9. TRASH DISPOSAL : WILDLIFE/Bear Resistant PROOF DUMPSTER!
Located at Main Entrance.
There is a bar that slides across the Dumpster lids: The bar has a permanent lock on it to stabilize it...and another lock with a key. We must keep the lock locked to prevent wildlife from getting into it.
NEVER PLACE TRASH ON TOP OF DUMPSTER OR BESIDE IT PLEASE!
ABSOLUTELY NO TRASH OUTSIDE OF RV: Or ROOMS PLEASE. Thanks.

10.CREEK AREA:
NO Tree Climbing please: We are not responsible for any accidents associated with tree climbing.
Creek Exploring: Children MUST MUST BE Supervised at all times in this area.
Closed toe shoes only please. Spiders and snakes love this type of landscape so please take caution while walking around in this area.
ALL Guests:
Feel Free To Roam: When you stay with us you have complete access to our entire 8 acre mini rustic resort. We have been building and adding onto our walking trail...it now almost goes around the entire property now.

11. Children must be supervised by an adult of 18 years or older at all times please. Please keep shoes on the children: As Colorado is known for its natural cactus.
Please have children return to their RV site or Room before Dark.

12. CELL PHONE SERVICE
AT&T is Best!
We are in the Mountains and its beautiful here>
Cell phone service can be spotty at best in the Valley and at most campgrounds in the area. There is typically a good AT&T signal here at our park. In case of emergencies, there is an office cell phone available. Please do not hesitate to use it if necessary. Note that Wi-Fi calling and texting works well on our wireless network.

13 . Use of the Outdoor Common area: Party Deck. This is a shared area and all guests are Welcome to use it. Has a propane gas grill( please supply your own propane) This area is Cannabis Friendly for those that are.

14. No ABANDONED PROPERTY AND STORAGE:
Towing Enforced.

15. Laundry Use/Room available:
We have a Mini- Laundry Facility for your use! Available from 1 pm to midnight for guests! Ask for quarters if you need these please. Sometimes we do run out.
We advise that you not leave your laundry unattended or left in the washer or dryer as other guests can remove it if it has sat there for some time. We are not responsible for damages or accidents or lost or stolen property of any sort.

16.ALL Guests:
Feel Free To Roam: When you stay with us you have complete access to our entire almost 8 acre mini rustic resort. We have been building and adding onto our walking trail...it now almost goes around the entire property now.

17. NO PERSONAL MAIL ALLOWED:
Please as it only creates an issue in that your mail seemingly always gets delivered here even after you leave. Thank You!
A PO Box is a better method as we are not responsible for lost or miss-delivered mail. Any mail that doesn't belong to Black Bear that is delivered to this address will be returned to the post office and sender.

18.. SEPTIC :
NO DOG BATHING WHAT-SO-EVER PLEASE!
Dog hair clogs up our lines quickly and could create the Motel or RV park from flowing correctly. In these parts of The Rocky Mountains we are all on Septic's.
. Please be kind to our Septic System.
Use RV toilet paper only or biodegradable only! No feminine products, baby wipes, paper towels or whatsoever to be flushed in toilets please. Our system is designed in that we could locate the clog.
They will clog our sewer lines and its $150.00 to $300.00 fee charged to you to clean them out.
As we are on a Septic System that is sensitive to feminine products and toilet paper wads. We use a dissolving biodegradable toilet paper product to ensure the lifespan of our Septic. No Female Products whatsoever in the septic please!

19.. ****. COVID 19: ( Not sure what the new rules will be on Colorado)
Masks are required when approaching the Manager or Office personnel or Owner please. Compliance with the 6 foot rule applies please! and any or all rules of the Governor.

20. ***Littering and cigarette butts: No trash or cigarette butts to be disposed of on any area of the property please , a charge of $25.00 will be charged to you if we have to clean up these butts or see you disposing them onto the grounds. Be mindful that we are in high desert and Cig butts are dangerous if not disposed of properly.
Pet Poop: Please be kind and respectful. We recommend using those plastic shopping bags from grocery store to pick up your Pets droppings. This is a great way to 2nd the use of those bags and be ECO friendly. Place droppings in designated Trash cans that are for Pet Droppings please.

RV PARK GUESTS:

Late or after dark arrivals are subject to an extra charge.

RV Park CHECK OUT :
12:00 ( Noon) PM
Contact the office before 11 am if you'd like to extend your reservation> Pre-payment is required and this option is based upon availability and pending bookings of that site.

b. ) Motel Room Check In: 2:00-3 pm depending upon the volume of our check outs. Check out is 11:00 am

4. RV service fee:
If you need assistance with other than the 1st initial assistance for hook-up we don't really offer this service. However, there are RV Service companies near by.

5.) Sewer Jacks are highly recommended. Please bring them with you, as it allows a nice steady flow and prevents any backfill.. These ensure that the sewer flow flows adequately into the sewer connection and prevents back fills into your RV or overflow onto the grounds should it ever occur.

6). Water Hose ( 25 to 50 foot)
Make sure you have plenty of hose to connect to our water supply , as our bigger sites are long and the water & sewer are at the end of the sites. Electrical in the middle.
A 50 foot water hose is recommended if you reserve one of our Big Rig longer sites. Also bring plenty of sewer hose connection ( 25 feet might be good) as these sites are long and depend upon where you place your RV as to how far away the connections are. Better to be prepared than not.

HEATED HOSES REQUIRED: "Camaco or Pruit "is best check on Amazon
( no make shift "heat tape" or duct tape hoses please!)
We do rent the hose's with a $150.00 Deposit at $2.00 a day. Deposit and rental fees must be paid in advance please.
We are not responsible for anything in your RV , freezing, pipe bursts etc. or anything other than initial hook-up assistance if needed and providing the normal utility hook-ups. Keep in mind that if the Park's water does happen to freeze that that is an act of weather and we cannot help it and if we do freeze up and we cannot get it unfroze or figured out on how to accommodate you, We may have to allow you to fill up your reservoir tank. Or if in a bad situation we may have to close the Park water lines for repairs. This would be a rare occasion. But in the winter you never know what will freeze.

8. Wi-Fi & password for the RV Park:
RV Park Wi-Fi: Guest RV Wi-Fi password: Request at check in.
Motel Wi-Fi: Black Bear Wi-Fi password : Is posted in the Rooms.

9. **** NO TRESSPASSING POLICY: Safety of our guests comes 1st!
Our park is for active registered guests only. In that we can keep our park safer and just for you " our guests" we do have this rule in play to keep the random traffic off our park to a minimum and our occupancy level at perfect minimum. Thank you

10.DAY VISITORS:
You are welcome to have daily visitors. Please inform us of any visiting guests that you may have please. Over night visitors are only allowed if they are registered with the office. $10 per person per night and must be approved. I agree that my visitors also agree that I nor they shall hold no harm or damages or liability to this establishment "Black Bear RV Resort Park & Motel in any form or fashion
" while on premises visiting.
Tenants/Guests: You are not at Liberty to move a visitor into your Unit or on the Black Bear Premises with out WRITTEN PERMISSION or without adding them to your reservation. Visitors are not allowed to stay for more than 5 consecutive days.

Any unregistered guests or visiting guests that are not registered with the office or do not have a current active reservation maybe accidently considered trespassing and we don't want to make a mistake or offend anyone. Thanks so much.
Please Understand that This is to provide the maximum safety, entertainment and space for all guests here. As we are located right off the Highway.

VISITORS: Day Visitors are welcomed and need to be registered with the office and provide a Valid Drivers License. No unauthorized visitors are allowed. We aim to keep the park safe and at a occupancy cap please.
Everyone that is not officially listed on the reservation is considered a Visitor.
Visitors that are here for over night stays are $10.00 per person per night and must have a pass and be registered at the office. Visitors may be subject to a background check for visiting longer term.

WE ARE NO LONGER ACCEPTING STAYS OVER 14 DAYS!
Longer term visitors: All other Visitor rules apply as well as these. These are for guests that are staying 28/29 day stays or longer if your stay is approved for extension or renewal of another 28/29 day stay. Any visitor that is not officially on the reservation or registered with a valid drivers license and often verifiable employment or a new 28/29 day stay agreement with visitor listed then it the visitor is considered a visitor. (No one here is a resident or permanent resident ) The office may verbally allow your visitor to be here for 10 to 60 days if considered a emergency or health related issue. After the 10- 30 to 60 days then the visitor may request in writing to the office that they be screened for being added to the reservation or guest stay agreement. This is all based upon the visitors behavior and ability to abide by the park rules.
A visitor is a visitor and is your responsibility to have them follow all policies and park rules. If your visitor violates any of the park rules or causes a disturbance then that visitor will be asked to leave....as then we have the right to ask the visitor to vacate the premises immediately. Zero tolerance for an type of disturbances from your visitors. If after the 10 - 60 days the visitor is not screened and officially added to the reservation and approved by the office then the visitor must and will be asked to vacate the premises voluntarily with out resistance or refusal. We have the right to refuse service or allow disturbing guests to stay here. Any damages that your visitor may caused to the property or etc. will be charged to you. All visitor pets must be officially registered and approved/ authorized by the office and shot records on office file. Any unregistered pet is considered a violation of the park rules and the owner/staff has the right to ask that such pet be removed from the property.

11.) ITEMS LEFT BEHIND:
Ooopps! No worries just let us know, you left something behind. Just give us a call or a text and we will assist you. Once guests leave/vacate the premises and their reservation has expired & is no longer active, please contact our office if you need to come back for any thing or any forgotten items, otherwise exited guests are no longer at free will to enter back into the park or be on the premises with out our permission. Thanks for helping in that we maintain our park to occupancy and reserved guests please.

12. GOOD CONDITION RV"S
Keeping Black Bear Healthy and maintained!
ALL Campers and RV's are required to be in good working condition and have working inside, electrical wiring, plumbing, water lines, working sewer, good holding tanks and in the winter "Propane heat source".
If your RV becomes dysfunctional please get it repaired ASAP ( 5 days).
RV technicians are available in the area to assist you in any small or major repair. No major repairs are to be performed on premises please. Unfortunately, Failure to communicate with us on this or failure to make immediate repairs to any of the above RV issues.... ( sewer bursts, holding tank leakage, electrical etc.
is or could be considered immediate grounds of Black Bear terminating your stay with us with out written notice and or refund of any paid rents.
We as the RV Park owners have the right to inspect your RV at entrance or any time that proves an issue of inadequate sewer or water line issues that maybe jeopardizing the RV Park grounds or other guests.
Thank you. Sorry but if we are notified about non working conditions of your RV. Of course you will be given time to fix the issue and we understand that things happen. And we may even have a solution.
However, non compliance of repairs over a long period of time, then we apologize but We do have the immediate right to execute a verbal notice, a written request or 3 day Quit or termination of your stay based upon this.

13. RV technicians are available in the area to assist you in any small or major repair. No major repairs are to be performed on premises please. Unfortunately, Failure to make immediate repairs to any of the above RV issues.... ( sewer bursts, holding tank leakage, electrical etc.

We as the RV Park owners have the right to inspect your RV at entrance or any time that proves an issue of inadequate sewer or water line issues that could be potentially jeopardizing the RV Park grounds or other guests.


14. OLDER RV"S: Older than a 2000 please send us a photo for approval please! We welcome vintage RV's that are remolded or in good condition. : written approval by Black Bear must be granted. Absolutely NO RV's that do not have inside working plumbing, sewer, electrical or Propane Heat source! So sorry and Thank You.

RV Sites:
15. RV Sites are priced for a 2 person occupancy only. Up to 2 Children 10 and under stay for Free! Extra Adults and Children 10 and older are $5.00 per extra person per day. Overnight Guest must be registered with the office and pay in advance for their overnight stay. Extra guests are $10.00 per person per night.
Any added 14 day or over guest must be reported to the office and a $100 fee applies if on an extended stay or its $10.00 extra per day per extra guest. This must be paid upfront and in advance please. Exception to this rule is for the longer term stayers. Longer termers: Rates are good for 1-2 adult person any children under 10 are free. Additional Adults are $100.00 per month more. All additional ad on guests must be approved by the office and you must please contact the office prior to allowing an additional person to live or stay in the camper on our RV Site. Please. We may elect to terminate your stay if these rules are not followed please.

16. Extended stay : RV sites must be kept clean at all times , Extended stays are responsible for weed eating their site or puling the weeds. keep site free of stacked up items, plastic tubs or anything that creates a uninvited appearance. ALL RV sites must remain clean and tasteful looking on the outside. This is an RV Park and its appearance is to be of a nice clean park. please.
Clean up fee of $50.00 and a disposal fee of $50.00 will be applied and is payable immediately to the office. We have a strike 3 your out policy. after 3 verbal warnings or a written notice you agree to vacate the RV park or Motel or our premises without resistance.


17.SHOWER HOUSE: TENT CAMPERS
Please text 719-207-5194 if you need shower house assistance or entry.
9am-6pm are my cell and office hours.
There is a fee for Shower House Use due to the fact that it runs off of a separate operational infrastructure other than the RV Park. However, arrangements can be made.
In COVID It is closed unless they allow us to open them. we ask that you please use cleaning products provided to ensure safety for the next guest please.

18. LATE FEES:
Late fees apply to any and all late payments made> Our apologies again on fees applied to daily, weekly or bi-weekly and on 28/29 stays.
. 28/29 day stays are due on the first of the month via cash, money order or check or if you use a debit/credit a 4- 5% processing fee applies. Late fees for all: $ 25.00 late fee on the 2nd day applies and then $10.00 per day late fee thereafter or 10% of the rates due. After the 4th day the RV site rate goes into a daily rate and unpaid balances due immediately and must be brought current. Thank you

19. **** RVs:
We are not responsible for or in any form or fashion for any damages done or occurred to your RV while on our premises through your stay by natural or unnatural occurrences or happenings. Fire, Flood or Snow. We are not responsible for any theft or stolen items inside or outside of your RV. IT is your responsibility to have an provide your own Insurance coverage for your RV.
In winter We are not responsible for icing down pathways< RV sites , Roads or driveways. You are here at your own Risk and are responsible for keeping your RV site free and clear of Ice, snow or debris. It is your responsibility to use salt Ice on your RV site if you'd like to do so. We are not responsible for any slips or falls due to the ice or snow, rain or other on the RV site, grounds or premises.
By reserving with us you have read and understand this and swear to hold Black Bear RV Park harmless and non- responsible of any and all damages, slips, falls or any and all types of personal injuries that may occur to you, yourself or any guest that you may have visit the RV park.
By accepting this reservation, booking and staying here you are in agreeance with this and firmly hold no responsibilities what so ever against Black Bear Resort, RV park or Motel.

MOTEL ROOMS :

Do not leave the AC units or heat going full blast if you leave the room for more than 2 hours at a time. We do our best to conserve in that we can keep our rates low and affordable.
Please TURN OFF all Lights, Heaters, Fans or Air Conditioning/Heat when you leave your room for long periods of time.
Inventory: Please make certain that you leave the rooms as you found them with the decorations, Linens etc. and inventory.

2. Pets:
Pet Deposit required and a standard cleaning fee required. Shot records must be on file at our office. NO dogs that bark continuously. All dogs must be in a kennel when you leave please.
Limit of 2 per Room: 40-60 lbs. No vicious or aggressive pets please.
Any dog that shows aggressive behavior to the owner/staff or other guest or tries to lung out at anyone or other dogs will have to be removed from the premises.
Pet Deposit required and a standard cleaning fee in rooms or any of Black Bears units. Crate or kennel pets if you leave for the day. Pets must be on a leash at all times.
Follow all pet policies please. Scoop the Poop! $25 charge if we have to scoop your poop. Please assist in keeping the property free of pet poop.

3. SEPTIC :
NO DOG BATHING WHAT-SO-EVER PLEASE!
Dog hair clogs up our lines quickly and could create the Motel or RV park from flowing correctly!
The Rocky Mountain Living!
. Please be kind to our Septic System.
Use RV toilet paper only or biodegradable only! No feminine products, baby wipes, paper towels or whatsoever to be flushed in toilets please.
They will clog our sewer lines and its $150.00 to $300.00 fee charged to you to clean them out. Clogs are able to be found and to whom caused them.
As we are on a Septic System that is sensitive to feminine products and toilet paper wads. We use a dissolving biodegradable toilet paper product to ensure the lifespan of our Septic. No Female Products whatsoever in the septic please!

4. Laundry Use:
We have a Mini- Laundry Facility for your use! Available from 1 pm to midnight for guests! Ask for quarters if you need these please. Sometimes we do run out but not often.
We advise that you not leave your laundry unattended or left in the washer or dryer as other guests can remove it if it has sat there for some time. We are not responsible for damages or accidents or lost or stolen property of any sort.

5. . CELL PHONE SERVICE
AT&T is Best!
We are in the Mountains and its beautiful here>
Cell phone service can be spotty at best in the Valley and at most campgrounds in the area. There is typically a good AT&T signal here at our park. In case of emergencies, there is an office cell phone available. Please do not hesitate to use it if necessary. Note that Wi-Fi calling and texting works well on our wireless network.

6 . Use of the Outdoor Common area: Party Deck. This is a shared area and all guests are Welcome to use it. Has a propane gas grill( please supply your own propane) This area is Cannabis Friendly for those that are.

7. No ABANDONED PROPERTY AND STORAGE:
Towing Enforced.

8.ALL Guests:
Feel Free To Roam: When you stay with us you have complete access to our entire 8 acre mini rustic resort. We have been building and adding onto our walking trail...it now almost goes around the entire property now.

9. RULES FOR ROOM GUEST:
Room Cleaning and Clean Sheets:
Most of our Guests prefer us to not enter their room unless they request cleaning, Clean Lines, exchanging of Towels or etc. We honor your privacy and are not offended if you want to be left alone during your stay. If you need something just ask and we will be happy to drop it off at your door step!
We will only Clean your room or enter it and or provide Clean Linens upon your request!

10. Linens: Towels:
Just send me a text if you need more clean towels or lines, our aim is to not to disturb you while you are on vacation! Have Fun!
Each room is limited to 4 Towels, 4 hand Towels and 4 Wash Cloths at any given time. Due to the cost of Inventory we are limited on the number of them that we can provide at a given time. However, just ask us for more as you need them and we can gather up your dirties and provide fresh Clean ones in exchange. Place all used Linens and Towels in the Basket Provided please!

PLEASE DO NOT USE THE WHITE TOWELS TO SOAK UP STAINS OR SPILLS. You will be charged 35.00 per soiled or ruined towels.
WE PROVIDE OTHER TOWELS JUST FOR THIS PURPOSE! These are located in the Laundry Room on the shelf right directly over the Washers.

11.. Free WI-FI Internet :
TV's operate off the internet : You can use your Netflix or Hulu here.
wi-fi Is available and a password is required, We must conserve on our bandwidth and be courteous of other guests. Remember you are in the Mountains and Valley and we can only provide what is available as we are not yet as Technologically advanced as the cities. NO STREAMING PLEASE. checking E-mails, surfing the net and other simple things are allowed.

12. Trash : Lets all be Eco friendly and try to conserve on the trash and waste of containers please! Please NO GLASS CONTAINERS! Glass is to hard to Dispose of and breaks easily. Plastic is acceptable. Please rinse out any can food or Tin cans and dispose of in our recycle bin. we encourage recycling!

**We ask that if you have time or want to you can Crush down plastic bottles after emptying them of their contents. It helps to cut down and make room for more trash to be held in the dumpster.
Follow the Dumpster Rules Please! They are Posted down by the Dumpster!
*** We are environmentally friendly and try to recycle plastic grocery bags to line our bathroom waste baskets with. If you like you may leave any that you may not use... in your room or at the office.

See Campground rules for a walk in the creek. OUR PLACE IS YOUR PLACE!
But walking in the creek can be a cautious thing. Wear closed toe shoes ..its rocky down there and we have seen snakes. Please supervise children in this area. We are not responsible for any injuries or accidents or bodily harm that occurs.

13 . Use of the Outdoor Common area: Party Deck. This is a shared area and all guests are Welcome to use it. Has a propane gas grill( please supply your own propane) This area is Cannabis Friendly for those that are.

14. DIATOMACEOUS EARTH: Because we are Pet and Children Friendly! We use this Eco Friendly Killer to rid off insects and Spiders. Please let us know if you notice any insects in the room. we treat the resort regularly but sometimes just being out in a country setting makes it difficult to get rid of them all.

15. Quiet Hours
10 pm to 9am Please!
Special permission is needed to have a gathering that might would interfere with these hours.
If you intend on having a Party or Gathering please inform the office in advance so that we can authorize it and
Inform other guests in that we do not disturb them please.

16.No unregistered guests or persons allowed please!
Overnight Guests are $10 per person per night. Thank you.
All incoming visitors that you have please must be registered with the office.
No unregistered Guests please in that we can keep up with our occupancy and the guests that are here please. A valid drivers license and visitor guest card or other information is required. Text Pamela 719-207-5194 and inform us of your guests please. All unregistered vehicles will be towed at owner's expense.

17. Overnight guest charges are $10.00 per person per night.

By placing and accepting your reservation with Black Bear Resort & RV Park being present or if not present or in person you automatically authorize Black Bear to sign the signature line as "Black Bear "on your behalf indicating your agreeance to this transaction and authorizing the charges for your reservation.
Black Bear will text or email you a receipt of such signature and receipt of the reservation amount charged and thus you agree to not disputing any or all of the payments or charges on such reservation. Based upon making and paying for and accepting the reservation, You agree to all the refund policies, park rules and other guidelines, waiver of liability and to hold Black bear Harmless of any and all injuries, accidents, of any sort and kind. as well as non dispute of charges. You agree to any cost of damages that may be caused: Damages to our utilities, buildings, Linens, other property. You are Giving and authorizing Black Bear to process your payment. And that at a later date for any reason you will not dispute such charges or the signature being signed as Black Bear if you are not present and the transaction is a manual entry. All Reservations and Payments are final. Deposits are non-refundable and refunds are non refundable. However, special circumstances may apply and proof of such circumstance would be needed from the customer to go for review of a special circumstance refund. Thus all refunds must be reviewed by Black Bear and the decision of a refund is the discretion of Black Bear. We agree at Black bear to credit our guests to a future stay based upon availability with in one year of date of the transaction. and apply any payments made to the new future reservation. If a refund is granted after review of circumstances then the customer agrees to the $50.00 cancellation fee and fees associated with the processing of such refund at the rate that our processing company charges. Our rates are subject to change at any time without any prior form of notice and can be in effect as early as the next upcoming month for 28/29 day stays or with in 3 days of rate adjustment for all other stays and as we deem fit to cover the costs and operational expenses of our Business and RV Park!
All rates will be displayed and updated accordingly on our website as well.

2 . WINTER GUESTS ONLY:
*** In the Winter ( Oct-April) we have a set rate for 28/29 stays. that rate is a flat rate and has an electrical usage allowance of $100.00 per 28/29 days per RV Site. .15kwh is the rate of electricity per anything over $100 of use.
PROPANE HEAT AS MAIN SOURCE OF HEAT IS THE ONLY HEAT SOURCE ALLOWED! PLEASE!

3. If you use Electric Heaters as a secondary heat source then it is your responsibility to contact the Office immediately to inform them of this use. and be advised that the RV site rent rate is subject to increase as a measure to offset the extra electricity usage of anything over the normal $100 allowance use of electricity use and fees. $ 300 upfront deposit required.
. Any electricity use or costs over the $100 allowance per RV site is your responsibility to cover that additional cost at .15kwh and is payable to the office on top of the flat rate for the RV site or in advance.

4. Electric heaters are NOT allowed as a primary heat source: This is dangerous and costly way to heat. PROPANE HEAT ONLY PLEASE!. If you DO use electric heaters as a main source of heat it is required that you report this to the office immediately and get your RV site rate adjusted for that electricity usage, YOU ARE RESPONSIBLE FOR THIS EXTRA COST and USAGE! and remember you are doing so ( using electric heat as main source against our policies and regulations) you will therefore be billed for that extra use of electricity above and beyond the flat rate of the normal RV Site rent rates.
If you fail to pay the extra usage at the time of the RV site rent is due then we have the right to terminate your daily, weekly or bi-weekly or 28/29 day stay with us immediately.. as our rates are based upon a $100 electric use consumption rate. Sorry for the strict rule on this.
and we would not be happy to do so but If non-compliance occurs then we have the right to terminate your stay with us and collect any unpaid fees or rents due and add an extra 10% to the daily rate. As our site rates are based upon propane heat source only.

5. WINTER RV SITES: HEATED HOSE!
Highly Recommended: .Heated Camaco or Pruit water hose is requested in that it protects your inside RV water lines from freezing and busting as well as ours. and is required to connect to our heated box water source please.. otherwise you can at your own risk fill up your water holding tank and run off of that. from Set Sept- May 1st. ( 50 to 75 foot) This protects your RV from its pipes freezing In the winter as well as a freeze to our lines which could create a shut down or breakage in our lines and system that could cause the whole rv park to be down without water and possibly forced to close up for the winter. please understand that YOU are responsible for any extra electricity over the $100 allowance at .15 cents per kwh ... that maybe used to supply to the heated hose, on the norm this cost is $2.00 per day or $60.00 per month. If you connect more than 1 hose such as 2 or more hoses it could double or triple your usage cost. We suggest one long continuous hose such as a 50 to 75 foot hose rather than tieing two hoses together in that the electrical costs is minimal in comparison to numerous hoses.

*** You may elect to not connecting to our water source and only fill up your holding tank in your RV as a means to get your water if you do not want to go the heated hose route.
Reminder we allow a $100.00 electrical use allowance only! But for the most part within this allowance the heated hose cost is covered so long as you DONOT use more than 1 hose any other electric heaters as a main or secondary heat source. If we experience issues with collecting the overage costs of electricity usage we may 1. Only allow or provide you the use to fill up your tank and would have to unplug you from the electric outlet and not allow you to plug in your hose...which we do not want to do at all or we would give you notice that a the site rent is increasing in that we can sustain and cover the extra cost.

7 . 28-29 DAY STAY AGREEMENT: Skip down if you are not staying 28-29 days!
We only offer
28/29 day stay Agreements only here. Our agreements are here in and now on the website here in these governing rules. We DO NOT Honor Month-to-Month Leases. We are not a residence and your continued stay is at owners/staff discretion based upon conduct and ability to follow park rules.
, here it is a 28/29 day stay agreement for a one less than one month period that is renewed only in and by written request or pre-paid reservation or an email from you to the office manager requesting such a renewal. If a renewal is not requested or received by us in email, writing or another form then we automatically assume and without further notice assume that you are exiting the RV Site or ROOM on your expiration ending date of your current reservation and without any intent or notice we assume you are not renewing and that the ROOM or RV site is open available and will be booked and reserved by another guest. We have the right to terminate your stay or not extend your stay at any given time.
each /28-29 day stay until properly terminated by either party. When a landlord and a tenant have not executed
a written lease and rental payments are made monthly,28/29 for a stay on the first of each month.
I do so agree to the agreement here below: This agreement is between me and Black Bear RV Park.

I Attest, Swear and agree to abide by all Park and premises policies, rules and regulations stated here in and I also attest to do so in favor of any of my visitors all rules/policies. I agree to be accountable for my visitors and comply if Black Bear owners or staff have to ask the visitor to leave. All rules on the website all rules listed and enforced. And by accepting this reservation and paying the payment I am in agreeance. I am in agreeance to All waivers of liability . That I have read each and every policy/rule and I am in complete agreeance with said and all rules/policies and that I agree to refrain from being non-compliant of such rules if in the event I become dis-favorable of them. I agree then to gladly vacate the premises at the end of my stay and cause no harm, malicious intent or hold this establishment responsible for any grievance based upon my change of mind or dispute of the rules here at Black Bear.
A. If I have a complaint I will put said complaint in writing and either hand deliver or email the business email or owner to seek resolution of my complaint.

2. I agree to pay on time: Site Rent or Room rent is due and payable on the first of each and every month. The rates are a reflection of a 28-29 days.
B. If i shall fail to pay on time I agree to pay the late fees without any issue or further discernment or debate or problem.

3. I agree that my RV site current rent rate is set up in that it has an electrical usage allowance of $100 per month for my RV site per month on electrical usage. I agree that anything over the allocated $100 per month allowance is my responsibility to pay. I agree to pay these overages to Black Bear Resort ( RV Park) in a timely manner and on and due with my normal RV site rent. I also agree that if I do not pay the overage charges that Black Bear has the right at any given time to raise my RV Site rent rate to a rate that allows for my overage use and up to 5% above the kwh rate being billed.

4. I agree that this is not a permanent residence and that if I want to renew this 28-29 day stay agreement for another 28-29 stay that I must do so in plenty of advance in writing, email or via request form. I also understand that in the event I do not request a renewal that My site is open to be booked and could so occur at any time online or any other way. If in the event the site I occupy gets reserved and I do not have a pre-approved renewal confirmation that I agree to exit, vacate and relinquish the RV site in the same good condition it was when I arrived and do so with out any refusal or grief. I will then accept that the RV site got booked and reserved and I did not ask for renewal or maybe I was not approved to be renewed at any rate I will vacate the site on my expected vacate date.

5. I agree that Black Bear has the right to increase their rates without further notice and may do so at any given time based upon their business needs or their own discretion. Black Bear will provide a 3 day notice via text or email in doing so on a rate increase. If I do not agree to the rate increase then we understand you are at my will to leave Black Bear voluntarily with out grief and find another place.

6.You may reserve an RV Site here at Black Bear for 3 consecutive months in advance by paying for such site in and in advance for such a reservation.

7. I agree that a $ 100 deposit is required for each 28-29 day stay that I intend to stay. A $300 deposit is required for a 3 month stay. These stays are based upon availability.

8.I agree that this is not a permanent residence and that I will not treat is as such. If I am asked to leave or my renewal has been denied than I will gladly without hesitation exit the Park at the end of my stay and allow the new reserved guests to come in and get the spot .I will get a PO Box for my personal mail.

Our park rules must be strict and followed in that we protect our guests and our Park. Thank you so much. Please read our Park Rules as they are meant to provide safety and ensure that each guest has an amazing experience. It is through experiences that our park rules have become strict. So very sorry.
Upon making the reservation , payment and rents you are testifying that you have read and fully understand our rules and policies reading the Rules and making a reservation you are Automatically agreeing to all policies/rules of The Black Bear Resort and it's premises. and are admitting to reading the rules here in and agreeance to honor all and not dispute, battle, or engage in conflict of any rule or policy here in. You also release and forever hold no harm, suit , responsibility or liability of Black Bear RV Park, Campground and Motel towards any accidents, slips, falls, or any type of injuries or risks involved or that may occur while staying on these property.

3. ****All 28/29 day longer term RV site renters are responsible for the upkeep of their RV site. weed eating if needed, appearance of the site. Raking out the gravel on the site. No Month to Month RV site rentals.. here it is a 28/29 day stay basis. Every Month you will need to renew for another 28/29 day stay!
Written request or written email request is needed to renew your 28/29 day stay. Without this notice Black Bear has the right to rent out the site as it is live online on various websites and up for grabs at all times unless written notice is requested for renewal.
RENEWALS: Black Bear has the right to refuse a renewal on renting you a RV site based upon various things such as:
1. RV site payment history. 2. Your ability to follow the rules. 3. How you get along with other guests and management and owners.4.Your respect shown to the management, owners and other guests as well as compliance with rules.5. paid Late fees. 6. If your RV is and has been maintained and in good working condition. and all utility supply lines working,7. Observance of all rules and policies and paying any extra electricity usage fees on time that you may incur in winter or other seasons.
You agree to give no grievance or issues, fight or battle to vacate the premises in regards to us not renewing your stay based upon any of these non-compliance issues, violations or any of the above.

6.RV site & Motel Room payments: All payments are due in advance of your stay or use of our RV sites, rooms or facilities. daily, weekly or 28/29 day stays: all RV site and Motel rents or payments are to be paid upfront and in advance of your stay. weekly and daily rents are subject to Colorado state taxes and fees. A 5% processing fee is charged on all debit/credit card transactions. If payment is not received in advance or on its due date or not paid in advance we have the right to cancel your stay or reservation and apply late fees and a $50.00 collection fee.

**** All monthly's(28/29 day stays) and weeklies are due on the 1st day that the week begins or 1st day of your arrival of your stay or on the 1st of the month with no grace period. If you refuse to make payment due or withhold rents due to us then we have the right to terminate your reservation immediately and ask you to leave the property immediately and remove your RV < vehicle or any and all of your possessions immediately. thus giving us the authority to apply late fees daily, and the collection fee and any other costs involved in the collection of rents due. As this is considered theft of services and breach of long term and short term stays. if taken to court we have the right to collect 3 times the amount of rents due to us plus any and all fees, or court costs related to such . Late fees will be applied. Its a 25.00 late fee that starts on the 1st day that you are late which is the 2nd of the month for28/29 day stays and a 10.00 per day late fee for any day late going forward until the balance due is paid plus any and all collection or late fees or costs involved. No personal transactions of any sort are to interfere with any or all Business transactions as those are separate and not a part of the Black Bear establishment or should it affect any of the rents due. Rent due is rent due.

7. Motel Rooms are priced based upon the occupancy level and the time of year or season that you reserve. and standard rate is a 2 person occupancy. Overnight Guest are charged at $10.00 per night per extra person and must be paid upfront and in advance and registered at the Office.

8. You are allowed ONE Vehicle per RV Site/Motel Room. Extra Parking is available in designated extra parking areas. All vehicles parked in a vacant RV site or any place other than extra parking will be charged the daily rate of that site for however many days it was occupied . This is not authorized at all and we will have no choice but to tow at owners-expense.9. Please DO NOT park your vehicle or extra vehicles in another empty RV site/Motel Room parking area as other guests have either reserved the site or are coming in and out daily. You will be charged for that site that you occupy at a daily rate of $40.00 per day or you will be towed at your expense without further notice. and if the vehicle is left unattended we may have to tow it at owner expense in that the reserved guest can get into their site.
We also have extra parking for ATV’s and Trailers. Check with the office for extra parking pass & fees. No unauthorized Vehicles what so ever.
again, Storage fees and storage: check with the office on the rates of this and the longevity of storing.

Storage rates are available for extra vehicles, trailers or etc. Check with the office on rates.$50.00 per month is the norm for vehicles. rates are subject to change.

10. Absolutely No mechanics on RVs or Vehicles on premises. We do keep a business card for RV repairs posted up at the main office. We are not responsible for any RV repairs. If caught doing so we have the right to Tow the vehicle at your expense. NO BROKEN DOWN or non registered or non running vehicles at all allowed on these premises.

13. DUMPSTER USE!!!
Dumpster Use: Absolutely NO personal outside trash or trash containers to be placed outside of your RV or Motel Room or Tent Site!!! We are in the Rocky Mountains and Wildlife/Critters are lured in from the smell & subject to come to the Park and tear up the trash< RV or Vehicles that contain food, soda cans and etc. NO Boxes or anything other than household trash to go into the Dumpster! We have cameras on the area and you will be charged for such. 25.00 disposal fee.

13 .Children & Pets: Always must be supervised by an adult or owner at all times. Pets must be on a leash at all times. We do have a Dog Park that allows pet owners a chance to let their pet off the leash to run and play, however, never leave the pet unattended at the Dog Park.
Children are not allowed to play in the Dog Park area freely and must only be in the Dog Park supervised and supervising their pet... as we have a designated play-area for the children to play. No unsupervised children in any area of the park at dark fall.NO TREE CLIMBING what so ever!

*** 14.. Children are not allowed to run and roam the premises without adult supervision. Remember we are in the Rockies and forest & wildlife surrounds us. Children are especially not allowed to freely roam or play in any area after dark alone. Supervision of an Adult with a flashlight is a must to ensure the children's well being and safety!

15.. Fires, Charcoal Grills, Fire rings:
We do sell wood here for the guests. $8.00 per bundle. Please purchase at the office during office hours. Fire Rings are available to rent for $3.00 per day or use. You must call the Howard Volunteer fire department at 719 942-4833 to get permission for any open fire even charcoal grilling. During the months of may thru- December or the dry fire ban times. Keep our park and mountains safe of fires! If not done then we have the right to ask you to put the fire out with an abundance of water or to leave our park.

16... NO open fires when we are in a stage 2 BURN BAN .No fires whatsoever on the ground...every fire must be contained in a charcoal grill or fire pit or ring.
You must check with the Howard Volunteer Fire Dept. first and always before having any type of open flame fire ( Fire pits, grills, campfires) Call Vol. Fire Dept. at 719-942-4833 and then report it to the office that you have the ok for the fire or grill.
As we are in the High desert and it gets dry! Dry! Dry! here and gusts of winds do happen and cause major fires that destroy our beautiful environment.

17. Outdoor Party Deck: located adjacent to the office/Laundry area; For Guests use.
We have a propane grill available for rental and your use. You must provide your own propane for your use. or rent one from us.
A stereo for music and shade. Please clean up all trash ‘ cans, and the grill after each use and leave the area in good condition for the next guests, Thank you! ALL TRASH to be carried down to the BEAR PROOF DUMPSTER please!
NO FOOD TRASH OF ANY SORT TO BE PUT IN ANY TRASH CANS ON THE PROPERTY! except for the Dumpster!

18. NO TREE CLIMBING at all please : as the branches could weaken and fall.

19. An Archery area is available. Please provide your own archery supplies. And check in with the office first!

During COVID we don't provide any room service. Text the office for clean towels or lines.

Most of our Guests prefer us to not enter their room unless they request cleaning, Clean Lines, exchanging of Towels or etc. We honor your privacy and are not offended if you want to be left alone during your stay. If you need something just ask and we will be happy to drop it off at your doorstep!
Room Cleaning is at an extra charge of $25.00 per cleaning!
We will only Clean your room or enter it and or provide Clean Linens upon your request!

6. Free WI-FI Internet : Is available and a password is required, We must conserve on our bandwidth and be courteous of other guests. Remember you are in the Mountains and Valley and we can only provide what is available as we are not yet as Technologically advanced as the cities. NO STREAMING PLEASE. checking Emails, surfing the net and other simple things are allowed.

7. Trash : Let's all be Eco friendly and try to conserve on the trash and waste of containers please! Please NO GLASS CONTAINERS! Glass is too hard to Dispose of and breaks easily. Plastic is acceptable. Please rinse out any can food or Tin cans and dispose of in our recycle bin. We encourage recycling!

8. Crush down plastic bottles after emptying them of their contents. It helps to cut down and make room for more! If you have Trash that needs to go to the Dumpster simply please dispose of it in the Dumpster or in the designated Trash Container

We are environmentally friendly and try to recycle plastic grocery bags to line our bathroom waste baskets with. If you like you may leave any that you may not use in your room or at the office.

We are not responsible for any accidents or injuries, slips , falls or any accidents. You are at Your own Risk. We are not responsible for any of your visitors accidents, injuries or any of the above what so ever while any guests stays at our property.

1. Check-In and Check-Out:
Fees for Early & Late check In/Out Times apply in that we can accommodate your stay!
Refusal of rents or payments of any form: If you refuse to pre pay your lot rent or room rent we have the immediate right to evict you from the premises and rent out your site or room! You agree to leave upon the immediate notice that we give you to vacate the property, rv site, room and premises. If you refuse to do so and we take it to court you are responsible for 3 times the amount due to us and any and all court costs involved at an expense to Black bear.

Late arrivals: Motel Guests and RV arrivals: RVr's Its best to arrive during the day light hours please! This way we can get you hooked up and not run over our Utilities! We do not have the bright lights to accommodate an after dark check in.

Arrivals after 6pm must make arrangements with us first please!

2. Please be kind to our Septic System. Use RV toilet paper only or biodegradable only! No feminine products whatsoever to be flushed in toilet.
They will clog our sewer lines and its $150.00 fee charged to you to clean them out. Clogs are able to be found and to whom caused them.

As we are on a Septic System that is sensitive to feminine products and toilet paper wads. We use a dissolving biodegradable toilet paper product to ensure the lifespan of our Septic. No Female Products whatsoever in the septic please!

3. Please no paper towels/ baby wipes or food to be flushed down the toilets please!

Winter Water Connecting Rules : All RV sites and RV site renters during the months of September 1st through May 30th are required to provide their own heated water hose an approved hose such as a Camaco or pruit in order to connect to our water source or water boxes during this time frame. No other hose or make-shift duct taped heat tape to a hose will be accepted. it must be an approved hose and approved by management or the owner. Please get the approval from the owner or manger on the hose and assistance in connecting or disconnecting from the water boxes. Do not tamper with the water boxes ask for assistance when connecting or disconnecting from the water risers or water boxes. as you will be responsible for any and all damages to the water lines, boxes or sources. and this is costly! If while staying at the park you receive a notice or grievance of this rule not being followed we have the right to disconnect you immediately from access or use of the water source or allowance of further use without prior notice. Once taken off the water source you must provide proof of the hose and get assistance in reconnecting to the water source. No excuses for non compliance .Thank you for understanding and for your compliance.
Every reservation requires a deposit to hold the RV Site or Room. Thanks.

We are not responsible for or in any form or fashion for any damages done or occurred to your RV while on our premises through natural or unnatural occurrences or happenings. Fire, Flood or Snow. We are not responsible for any theft or stolen items inside or outside of your RV.IT is your responsibility to have an provide your own Insurance coverage for your RV.

In winter We are not responsible for icing down pathways. RV sites , Roads or driveways. You are here at your own Wintery Risk and are responsible for keeping your RV site free and clear of Ice, snow or debris.
It is your responsibility to use salt Ice on your RV site if you'd like to do so. We are not responsible for any slips or falls due to the ice or snow, rain or other accidents on the RV site, grounds or premises.
By reserving with us you have read and understand this and swear to hold Black Bear RV Park harmless and non- responsible of any and all damages, slips, falls or any and all types of personal injuries that may occur to you, yourself or any guest that you may have visit the RV park.
​Refunds and Cancellations: Deposits are NON-refundable as they are security in reserving your room or RV site and that marks it out as unavailable for the length of your reservation on our calendar as reserved, thus, if you decide to cancel Black Bear loses the opportunity to rent the room or site to a definite reservation. This is why a deposit is taken. Upon making and accepting the reservation you are automatically agreeing to the cancelation policy. We do not refund payments made to us on reservations or in full payments.
We will credit you for a future use of the deposit amount or of the of the reservation payment made.

Absolutely No refunds during peak season:
March- December. may-September
If we do warrant a refund due to special circumstances and after review that must be approved we have the right to determine the percentage of the refund. We will however credit you a future stay with us and apply your deposit or payment to a credit towards a future stay with us for up to 2 years. There is a $50.00 Cancellation fee And a reversal fee of 5% As a reservation does take time and staff to create the reservation and the processing company charges a refund fee. No refunds are granted for early exits if you decide to leave out early no refund on that will be granted. Thank you so much. We do apologize for our strict policy and procedures however, due to avoidance of any issues we have placed these procedures and policies to all reservations. All guests that reserve or stay with us accept all the rules and regulations and procedures here in. All Guest upon providing their debit or credit card information authorize Black Bear to manually enter, process and sign the signature line as Black Bear as your physical presence is not here and the signature line must be signed to process your deposit or reservation. You are in agreeance that you will not dispute the charges or " Black Bear Scribbled Signature as you have authorized us to do so in your favor and out of your presence & processed by Black Bear or come back and say that you were not aware of the policies and procedures of the processing of the reservation. By placing and accepting this reservation at Black Bear RV Park and Motel and making a Deposit you agree to the terms and conditions set in on our refund policy. All Deposits are non-refundable but if you do have to do a cancellation the Deposit can be used or applied for a future reservation for yourself, family or friends for up to 1- 2 years based upon availability. If we do honor a refund of any type upon administrative approval and Guest proof of an unusual circumstance than a $50.00 Cancellation fee is applied as well as the reversal fee that the processing company may charge the Business. More information is below at the bottom of this page.

Credit/debit card processing: Your reservation has tax on it unless it is a monthly stay or tax exempt. And there is a 4% processing fee to process your payment with a debit or credit card. that each guest is charged. So your reservation will be with tax and the 4% fee.
Also all manual credit cards or debit card transactions are 5%. The guests is authorizing Black Bear to sign the signature line as Black Bear in that we may process the payment for your reservation. No dispute of such shall occur. as this is given permission from you the guest.

As of Aug 2020 each guest must provide a valid credit/debit card to be and remain on file for the duration of your stay for any damages that could occur that you may be liable for. By this you authorize Black Bear to charge the card for such damages, or any theft or non payments of rents with out further notice. any attempt to not pay these fees or damages or trying to report your card lost or stolen or denial of this will be provided a copy of these rules to your debit/credit card holder or bank of dispute.

REFUNDS AND AGREEMENT POLICY

We do apologize for our strict policy and procedures however, due to avoidance of any issues we have placed these procedures and policies to all reservations. All Guest upon providing their debit or credit card information authorize Black Bear to manually enter, process and sign the signature line as Black Bear as your physical presence is not here and the signature line must be signed to process your deposit or reservation. By placing and accepting this reservation at Black Bear RV Park and Motel and making a Deposit you agree to the terms and conditions set in on our refund policy. All Deposits and paid reservations are non-refundable but if you do have to do a cancellation the Deposit or reservation paid for can be used or applied for a future reservation for yourself, family or friends for up to 1- 2 years based upon availability. If we do honor a refund of any type upon administrative approval and Guest proof of an unusual circumstance than a $50.00 Cancellation fee is applied as well as the reversal fee that the processing company may charge the Business. or a partial refund maybe granted at a later date (7-10 days) based upon if the room or RV site re-books for those exact dates. No refunds during peak season May-September as our availability is limited. thank you so much. No refunds during peak seasons especially summer March-November.


ABANDONED PROPERTY AND STORAGE:
Posted signs are at the office: In that we keep our Park clean and free of left behind or abandoned property or property owners that refuse to remove or take their property it is here posted and by payment and reservation you have agreed to and acknowledged this policy. Abandoned Property or left behind property: Cars, Vehicles, Trailers RV's or other property left behind or on an RV site or in a room or on premises: All property left on premises with out a written special storage form signed and agreed upon and witnessed .is not our responsibility. All property left here after 72 hours is in violation and is to be towed at owners expense. This includes all RVs, Campers, vehicles trailers, ATV's and etc. We have a $25.00 a day rate which is effective after the 72 hour period for any Left or abandoned RV or any property. If you leave your RV here unattended or any property on an empty RV site or the current site you reserved you are required to pay the normal daily rate of that RV site ( $45.00 per day )or storage site rate of $25.00 per day for the amount of days you left it in a RV site. This is considered hindering our flow of business income and you are responsible for any income loss we may loose incur from deliberately occupying a or any RV site or our storage parking at a normal daily or monthly and as well as the considered seasonal rates in effect. rate loss or damages that may occur to abandoned or left property at any time during your stay, during the 72 hours you left it or anytime thereafter. Refusal to acknowledge a text message notice or request to to pick up and remove said left/abandoned property gives us full rights to the property to Tow it at your expense, remove it to one of our other property locations, impound it for the daily fees plus expenses.
If you leave your RV unattended for more than 72 hours without notifying the office and getting an signed and documented special approval form that must be signed by Both Black Bear and you the guests then we will automatically assume that you have abandoned and left the property here and the 72 hours begins.

remains in the property as a “holdover,” with the landlord’s written consent. In such a case, if the written
lease or agreement contains a clause stating that all lease provisions continue to apply after the written lease expires
and the tenant stays on with a month-to-month lease, or 28-29 day stay then the rights and responsibilities of each party,
as defined by the expired written lease, or website rules and policies remain in effect.
With any month-to-month lease, or 28-29 day stay agreement the landlord can raise the rent, change or terminate the agreement at any time or at
the end of each month, or 28-29 day stay agreement. With proper written notice to the tenant the RV Park landlord can terminate the stay at their discretion. The tenant, likewise, can terminate
the lease or 28-29 day stay at the end of the stay or month with proper written notice to the landlord. Proper notice for both
landlord and tenant must be written and received by the other party at least ten days before the
last day of the rental month. (See C.R.S. § 13-40-107). However, a written month-to-month lease ( we do not do these month-to-month leases here at Black Bear)
may specify a longer notice period, for example, 30 days or 60 days before the end of the lease term if there is a written lease and the term is 6 months or longer. Remember this is a 28 to 29 day stay agreement and in not a lease.

BLACK BEAR CREDIT CARD AUTHORIZATION AND REFUND POLICY
By placing and accepting your reservation with Black Bear Resort & RV Park being present or if not present or in person you automatically authorize Black Bear to sign the signature line as "Black Bear "on your behalf indicating your agreeance to this transaction and authorizing the charges for your reservation . Black Bear will text or email you a receipt of such signature and receipt of the reservation amount charged and thus you agree to not disputing any or all of the payments or charges on such reservation. Based upon making and paying for and accepting the reservation, You agree to all the refund policies and non dispute of charges. Giving and authorizing Black Bear to process your payment. And that at a later date for any reason you will not dispute such charges or the signature being signed as Black Bear if you are not present and the transaction is a manual entry. All Reservations and Payments are final. Deposits are non-refundable and refunds are non refundable.However, special circumstances may apply and proof of such circumstance would be needed from the customer to go for review of a special circumstance refund. Thus all refunds must be reviewed by Black Bear and the decision of a refund is the discretion of Black Bear. We agree at Black bear to credit our guests to a future stay based upon availability with in one year of date of the transaction. and apply any payments made to the new future reservation. If a refund is granted after review of circumstances then the customer agrees to the $50.00 cancellation fee and fees associated with the processing of such refund at the rate that our processing company charges. BY ACCEPTING THIS RESERVATION AND READING and making deposit or payment you are verifying and acknowledging using such said reservation as a form of your signature. and that you are in absolute agreeance of all its contents...with that you have read and understand all of our policies and rules. THESE POLICIES In That YOU AGREE TO ABIDE BY ALL RULES AND REGULATIONS HERE IN. Understanding that the policies are here based upon previous experiences and in that we can provide a better experience for our guests. You are acknowledging that you waive the right to hold Black Bear responsible and harmless in any form or fashion and that you waive the right to file suit or seek retaliation , damages or grievance against this Establishment in any form or fashion in reference to the rules and policies herein.

CHILDREN & PETS
Children are welcome with an accompanying adult. Children age 10 and under stay free. Pets are welcome. Pets must weigh under 160 pounds. PETS and Fees Pets are allowed at the RV Park, Campground and Motel Rooms. Pets- $5.00 a Night ( Maximum Charge $20.00 a week for RV Sites) RV Site: $50.00 Cash deposit for site cleaning Please use doggy bags or plastic grocery bags to pick up your pets droppings if you walk your pet around the Park please. Please Do not allow Your Pet to potty on other Guests RV Sites or areas that guests enjoy. Pets must be leashed at all times while staying at the Black Bear...when outside of cabin room, and all messes must be immediately picked up and properly disposed of please! Motel Rentals and Pets: Pets: Motel Room: $150.00 deposit( refundable) $35 Carpet Cleaning Fee. A limit of 2 pets are allowed in the Cabin Rooms. A refundable $150.00 Cash fee will be required and refunded after departure, if no damages have occurred and if there is no excessive cleaning. Rooms are thoroughly inspected pre-arrival and upon departure. Vacuums are available at the office for guest use. We have a Dog Park and ask that you use the Designated area for Your Doggy Potty Area. We do Charge $50.00 extra for Poop Scooping. Pets must be leashed at all times while staying at the Black Bear...when outside of cabin room, and all messes must be immediately picked up and properly disposed of please! Pet fees are non refundable and are dependent on length of stay. Stays longer than one week will be charged each week. A limit of 2 pets are allowed in the Cabin Rooms. Pets are not to be allowed on the furniture, and cannot be bathed in the bathtubs. Please! A refundable $150.00 Cash deposit fee will be needed and refunded after departure, if no damages have occurred and if there is no excessive cleaning. Rooms are thoroughly inspected upon departure and the day of arrival. Vacuums are available at the office for guest use. Pets are not to be allowed to roam unattended at the cabins, RV Park or Campground. If they must be left unattended, they must be kenneled, not leashed. If you are unable to keep your pets waste picked up then we will have to charge you for the extra clean up $50.00 per occurrence or ask that you not have the pet here any more. Respect the other RVers and only take your pet out to the designated area for restroom potty! Never allow your pet to use the restroom in the RV park or on someone else RV site Please! or Motel area or on another persons site. ​If we find poop on your site we will have to charge for the clean up $50.00.. Sorry but we all need to think of the next guests coming in, Thank You!. We are a Pet Friendly park. Please keep Cats inside your RV at all times unless you have a caged enclosure that does not allow an escape. Please do not leave your pet unattended or tied up unless you are supervising the pet. We are not responsible for injuries or lost off of a leash, runaways or accidents that may occur to your pet while staying at the Black Bear Campground. Please do not allow your dog to bark continuously or otherwise disturb other campground guests. Motel Guests: Pets are to be under your supervision at all times. If your pet has an accident and requires us to carpet clean a $50.00 fee will be charged to your rate for the clean up. Please keep your Pet on a leash when walking around the premises. Salida, the nearby town offers numerous options available for doggy daycare and pet sitting. Please do not allow your pets into the common area, restrooms or to roam around freely and unattended. PETS Pets are allowed at the RV Park and Campground. Please use Your own doggy bags or plastic grocery bags to pick up your pets poop! Pets are allowed in the Rooms with a $125.00 Pet deposit. $45.00 fee for carpet cleaning comes out of the deposit. for pets under 20 lbs and $50.00 fee for pets over 20 lbs. Pets must be leashed when outside of cabin room, and all messes must be immediately picked up and properly disposed of.
